SERVICE INFORMATION AND FEES LIST
PRE-PURCHASE ADVICE
We can review a Contract/Section 32 and advise you before you make an offer on a property. Our fee for pre-purchase review is $175 incl. GST. We will thoroughly check the Contract/Section 32 and provide advice in a written report or in consultation. As part of this advice we will also give you practical information such as dealing with the agent, first home buyer concessions general advice, building inspections and conditions, how to make an offer, auction process, when to make payments and when to carry out inspections. Pre-purchase review is a separate and optional service, not included in the conveyancing fees below.
You are welcome to contact us to discuss your purchase plans and get some initial practical advice (no charge).
We require at least two clear business days to review your contract, otherwise an urgent review surcharge will apply (surcharge $75, total fee for urgent review $250 in 1-3 days).
Off The Plan - Off The Plan contracts are substantially different from existing property contracts. They tend to me more lengthy, complex and carry more risks for the Purchaser. Our fee for reviewing an Off The Plan contract is $275 including GST. This covers review of a Contract of Sale and Section 32 for an off the plan property (review of separate building contract is not included).
PURCHASER - Conveyancing Fees (after you have signed a Contract)
Conveyancing fee is $1,100 including GST payable at settlement (existing property).
Conveyancing fee for an Off The Plan Property is $1,300.
Our fee includes all the conveyancing work that is required until settlement, including checking and drafting legal documentation and stamp duty statements, advising you, communication with banks, other lawyers and government authorities, councils and owners corporations, checking financial information to ensure correct amounts are paid at settlement, attending settlement, payment of stamp duty and completing registration of your details on the title . This fee includes completing the first home buyer stamp duty concessions or pensioner concession forms if applicable.
Disbursements are information search fees payable to the Land Titles Office, council, water authority and the Owners Corporation (if applicable), banks, other lawyers and any other organisation leading up to settlement. You should add around $100-$250 to your budget to cover these fees.
All settlements in Victoria are required to be completed electronically on the PEXA platform (used by the Land Titles Office and all major banks). PEXA charges $114 at settlement. This is another extra fee you should include in your budget.
Estimate of TOTAL conveyancing costs for a Purchaser including GST, disbursements and PEXA Electronic settlement fee is $1,350. Off The Plan property is around $1,550. These costs are all payable at settlement.
SELLER - Conveyancing Fees
Conveyancing work fee is $1,100 including GST payable in two instalments - $330 is payable for drafting of the Contract and Section 32 and $770 is payable at settlement. If you withdraw the property from sale you will not need to pay the second instalment ($770).
This covers our work including drafting all legal documentation and State Revenue Office duty statements, applying for ATO clearance certificates, advising you, communication with banks and other lawyers, government authorities, councils and owners corporations, checking financial information to ensure correct amounts are paid at settlement, post settlement lodging and banking if necessary. Our fee includes all the conveyancing work that is required until settlement.
Disbursements are information search fees payable to the Land Titles Office, council, water authority and the Owners Corporation (if applicable), banks, other lawyers and any other organisation leading up to settlement. You should add around $100-$250 to your budget to cover these fees. They are payable by you as we draft the Section 32. You should add around $100-$250 to your budget for these (Owners Corporation fees will be $250) These fees are payable so we can obtain up-to-date information about the property which is required by law to be included in the Section 32.

Legal disputes will incur legal fees, see usual professional services rate below. We will warn you of any applicable legal fees before they arise.
Most conveyances progress smoothly and you should not automatically expect that you will face problems or incur extra fees. If minor issues of a legal nature arise during the course of a conveyance, Windsor Legal is able to deal with those issues and you will not be charged additional fees. We are lawyers and are able to deal with minor disputes quickly and effectively.
OTHER PROPERTY AND COMMERCIAL SERVICES
$3,300 for sale or purchase of a small business (may vary depending on individual circumstances). Does not include disbursements (eg. authorities charges). Please provide further information about your business for a more accurate quote.
$990 for review and advice regarding a commercial lease, payable in full before providing advice.
$1,200 for drafting and advice regarding a commercial lease, payable in full prior to release of the commercial lease.
$600 to review, advise and certify a bank loan agreement. Payable prior to release of advice and certification.
$1,100 for a subdivision application (per lot), of which $330 is payable within 1 month of appointing Windsor Legal and $770 is payable on registration of the plan (not including disbursements).
$990 for related party property transfers where no Contract of Sale is required (not including disbursements). Fee quoted is for each party.
$275 for Foreign Investment Review Board (FIRB) applications relating to the purchase of new property or land in Australia by foreign nationals, payable in full immediately prior to lodging the FIRB application.
$275 Lodging or withdrawing a caveat, payable in full before the caveat application is lodged, includes Land Titles Office fees.
$275 preparation of a Licence Agreement, payable in full on settlement (i.e. The need for a Licence Agreement arises when Sellers and Purchasers agree that the Purchaser can move in to a property prior to settlement).
General property and commercial law advice is available and is charged at the usual professional services rate of $325 per hour incl GST.
